The Federal Supreme Court confirms the legal opinion of Urs Urs Hofstetter-Arnet and Domino Hofstetter that there is a close spatial and functional connection between a new cinema building and an existing shopping centre within the meaning of the Environmental Protection Act (USG[SR 814.01]). The Federal Court has thus followed the argumentation of Hofstetter Advokatur & Notariat that there is a complete facility in the legal sense (see Art. 8 USG) which is subject to an environmental impact assessment (EIA) (BGer 1C_291/2018 vom 3.
