The amendments to the Environmental Protection Act relating to noise protection and the revised Noise Protection Ordinance will come into force on 1 April 2026. This will significantly clarify the noise-related requirements for planning permission and better align them with inward-focused urban development. The new regulations establish a clear legal framework for building zones in noise-polluted areas and open up additional scope for the development of attractive residential projects despite challenging conditions.
For developers and investors, this means greater planning certainty: residential buildings in noise-polluted areas may in future be approved even if compliance with the limit values can only be achieved at disproportionate cost – provided that suitable technical or structural measures are planned, such as controlled ventilation.
