Webinar: ‘HVAC industry – liability issues in practice’

The heating, ventilation and air conditioning (HVAC) sector is subject to technical requirements, complex contractual relationships and legal regulations. If damage occurs – for example, due to faulty installation, a defective component or incorrect settings – the question of who is liable quickly arises.

As part of a webinar entitled "HVAC industry

– Liability issues in practice" organised by GebäudeKlima Schweiz (GKS), Domino Hofstetter, solicitor, notary and specialist solicitor in construction and real estate law, and Stefan Mundhaas, solicitor and holder of the CAS in Environmental Law and Enforcement, highlighted key issues of non-contractual and contractual liability law in the field of heating, ventilation and air conditioning technology. The speakers made it clear that the answers to these questions depend on the interplay between the content of the contracts, the applicability of private law and/or technical standards, and their provability in specific cases. Using numerous practical examples, the speakers also showed how technical errors, unclear responsibilities or missing documentation can lead to legal problems – and how manufacturers and suppliers can effectively protect themselves against this.
